Litigation Support – Consulting and Testifying Expert Witness
The expert in a litigation involving life insurance is crucial. Litigators for the most part don’t know and understand transactions involving life insurance and don’t know what to look for in the documents produced in discovery. An expert with the knowledge, experience and credentials can make the case. There are very few who have those qualities and can also testify.
The results are the proof. In completed cases I have been successful for my clients 100% of the time. By successful I mean that a settlement was reached when none or a very modest one had been offered or the case was heard and the verdict was for my client.
How? I don’t take cases I don’t think are winnable. When I am retained I produce support, opinions and testimony that are factual, concise, understandable and impartial. I can educate a judge, a jury or an arbitration panel so that they understand the issues. I am able to review the exhibits and reconstruct what took place. I can ferret out details and find information that is often overlooked. I have written on and/or spoken on the topics I work as an expert on. (I’ve had my material cited by an opponent). I have very high standing in my industry and am considered accomplished, ethical and credible. I am thought of nationally to be one of the most knowledgeable people in my field and a thought-leader. And I have the achievements to back all of it up.
I work for both plaintiffs and defendants.
The majority of cases I’ve worked on were settled. I’ve had cases settled after I’ve been deposed. I’ve had cases settled after I’ve given my written expert opinion. I’ve had cases settled after I’ve provided support to the attorney.
Of the cases in which I testified all were found in favor of my client. In two of the cases the awards were for the total amount sought. I have testified in US District Court, state courts, arbitrations, and FINRA arbitrations.
I have expertise in the following areas relative to life insurance:
- Suitability
- Standard of Care
- Structure of the transaction
- Commercial financing to pay premiums
- Split-dollar arrangements
- Policy ownership arrangements
- Estate planning and income tax issues
- Business continuation plans
